These general terms and conditions define the rules and regulations for the use of the Konstantina MALATHRITI (EN ESPRIT) website, located at https://konstantinaparistours.com.

By using this site and booking a tour, you agree to be bound by these General Terms and Conditions of Sale.

PREAMBLE

These General Terms and Conditions of Sale (GTC/TCS) govern the guided tour services offered by Konstantina MALATHRITI (EN ESPRIT).
The sole proprietorship Konstantina MALATHRITI (EN ESPRIT), whose headquarters are established in Puteaux, is registered under SIRET number n°95330003500011.
In accordance with current regulations, the guide holds the professional Guide-Lecturer card, issued by the Ministries in charge of Tourism and Culture, in accordance with Articles R.221-1 et seq. of the Tourism Code (Code du Tourisme).

Any booking implies the client's full and unreserved acceptance of these GTC, and the client acknowledges having the legal capacity to contract.
These GTC may be modified at any time; the version in force is the one published on the website www.konstantinaparistours.com at the time of booking. They can also be communicated to the client upon request.

ARTICLE 1: ORDER AND RESERVATION

Guided tour reservations are made via the contact form available on the website: https://konstantinaparistours.com/contact.
Sending this form constitutes a request for a quote, without mutual commitment.

Upon receipt of the request, Konstantina MALATHRITI (EN ESPRIT) undertakes to send the client a detailed quote by email within a maximum of 72 working hours.
This quote is valid for 30 days, subject to availability at the time of confirmation.
The reservation becomes effective only after the receipt of a written agreement in response to the quote sent.

ARTICLE 2: PRICES

The prices indicated in the quote cover exclusively the guiding service as described, unless otherwise stated.
The prices displayed on the website are indicative and may be modified without notice.
Services will only be billed based on the quote validated by the client.
Prices are expressed in Euros, inclusive of all taxes (TTC), at the current VAT rate (20%).

ARTICLE 3: PAYMENT TERMS

Payment for services may be made by:

bank transfer,
online credit card,
cheque (drawn on a bank domiciled in metropolitan France) made payable to EN ESPRIT,
or cash.

Payment must be made in full no later than 7 days before the date of the tour.
Upon receipt of payment, Konstantina MALATHRITI (EN ESPRIT) will send the client a confirmation by email accompanied by the corresponding invoice.

In the absence of payment within the specified deadline, Konstantina MALATHRITI (EN ESPRIT) reserves the right to cancel the service without compensation.

In the case of a reservation made less than 7 days before the tour, payment may exceptionally be made on site (cheque or cash), subject to prior agreement and signature of the quote.

ARTICLE 4: CANCELLATION AND REFUND

Cancellation by the client:

Any confirmed cancellation after signing the quote is subject to the following conditions:

Cancellation more than 30 days before the service: 50% refund of the total amount.
Cancellation less than 30 days before the service: no refund will be issued.

Refunds are made by bank transfer within 7 working days after receipt of the request, along with the client's bank details.
A credit note (facture d’avoir) will be issued by Konstantina MALATHRITI (EN ESPRIT).

Any modification to a reservation (change of date, time, location, or tour) after signing the quote may incur an administrative fee of €120 including all taxes (TTC), subject to availability.

Cancellation by the guide:

Should it be impossible to provide the tour, either by Konstantina or by a colleague guide without supplementary charge, Konstantina MALATHRITI (EN ESPRIT) will offer the client:

either a postponement of the service to a later date,
or a full refund of the amount paid.

In case of a hindrance beyond the guide's control (unforeseen site closure, strike, bad weather, access restrictions, etc.):
Alternative solutions will be offered (change of itinerary, postponement).
No compensation may be claimed.

ARTICLE 5: TOUR CONDITIONS

The guide undertakes to be present at the agreed date, time, and meeting place.
The client must ensure their punctual presence at the indicated meeting point.

In case of client lateness, the guide will wait up to 30 minutes after the scheduled time.
The original duration of the tour cannot be extended.
In the event of the client's absence beyond 30 minutes, the tour will be considered cancelled and non-refundable.

Tours are maintained in all weather conditions, except in exceptional safety circumstances.

ARTICLE 6: CONTENT AND CREDITS

Konstantina MALATHRITI (EN ESPRIT) is solely responsible for the content published on its website.
The texts, images, and photographs used to illustrate the tours are purely indicative and do not constitute a contractual commitment.

Any reproduction or use, in whole or in part, of the content of the website www.konstantinaparistours.com is strictly prohibited without prior written authorization.
Failure to comply with this prohibition constitutes an infringement (contrefaçon) that may incur the civil and criminal liability of the offender.

Konstantina MALATHRITI (EN ESPRIT) cannot be held responsible for any errors or omissions on the website, nor for direct or indirect damages related to its use.
External links present on the site are provided for informational purposes and do not engage the responsibility of Konstantina MALATHRITI (EN ESPRIT).

ARTICLE 7: LIABILITY

The services offered by Konstantina MALATHRITI (EN ESPRIT) comply with French legislation.
Any dispute falls under the exclusive jurisdiction of the French courts.

Participants remain responsible for their personal belongings and effects during the tour. Konstantina MALATHRITI (EN ESPRIT) cannot be held responsible for:

theft, loss, or damage to participants' belongings,
personal injury or property damage occurring during the service,
damage caused to third parties by the client or members of their group,
damage committed in the sites or museums visited.

Each participant is advised to have personal civil liability insurance.

ARTICLE 8: CONFIDENTIALITY AND IMAGE RIGHTS

Participants may take photos or videos during the tour, while respecting the rules of each site. Any publication of these images on the Internet implies the prior consent of the people appearing in them, including that of the guide.

Complete audio or video recordings of the tour are prohibited, except with express authorization..

ARTICLE 9: PERSONAL DATA PROTECTION

Konstantina MALATHRITI (EN ESPRIT) collects and processes only the data necessary for the management of requests and bookings (name, first name, contact details, practical information). This data is confidential and will never be shared with third parties without the client's prior agreement.

ARTICLE 10: DATA RETENTION AND SECURITY

Personal data is processed by Konstantina MALATHRITI (EN ESPRIT), the data controller.
This data may include: last name, first name, nationality, contact details, and information necessary for the proper organization of the tours.

It is kept for a maximum period of 20 years to ensure customer follow-up.
Access to the data is secured by protected and regularly updated passwords.
Clients may request the modification or deletion of their information at any time.

In accordance with Articles L.616-1 and R.616-1 of the Consumer Code (Code de la consommation), Konstantina MALATHRITI (EN ESPRIT) has designated the following mediation entity:
